I am on the NC State Insurance Plan as are all teachers and state employees. County employees are on a different plan. Right now there is a 90/10 plan, 80/20 plan and 70/30 plan with different amounts of money paid for major medical issues. It's a confusing plan at best. We have already had our formulary changed because we were told that we are taking too many anti-depressants.

So today we received a letter stating that our wonderful legislators have proposed to change the State Plan according to a persons BMI and smoking habits. The 90/10 plan is gone with or without these changes. A person can only get the 80/20 plan if they have a BMI of 24.9 or less and don't smoke. Then the BMI is incremented up until the person can not qualify for the State Plan and if they smoke with or without a good BMI they're out.
Is this legal? I've seen our legislators the entire PORKY lot of them.
