I think I started posting pictures of this road project in December or February. The road crews are making great progress in my eyes but we still haven't seen one dollar and now someone has torn the siding off the gable on one side of the house. I first noticed it after the cable men were here moving lines but of course they have denied doing it. So I called the power company because they were also moving lines, but of course, they denied it, so I called Verizon because they have also moved line, but of course they have denied doing it. I'm not sure what the next step is. My husband called the cable man again and he actually told him that he's been instructed not to discuss this with him anymore. My husband asked him to write a letter stating that and he said he would but we haven't seen it. Any ideas?

so the readers digest version is----go to a lawyer---you have been walked on long enough over this problem in my opinion--and will continue to be walked on until they are done and you have NO recourse if you do not see prfessional advice now. Sounds to me like they all know this.
not to worry about the fees, many have a 1 free consultation policies and many will not charge you unless you are victorious---call and ask questions first--and chose a lawyer that specializes in this type of thing specifically.
Good luck!!--- remember, I am thinking that all of these people are tresspassing until they have a signed paper saying that you do not own said piece of property any longer, OR that you have signed a waiver----have you done either???
I agree Loz. And I had to call the Utilities Commission to get a response from Verizon. Now the ball is back in our court. We're to get two estimates. I hope we get two really high ones. They deserve it.
And by the way. I despise Time Warner. That is the sorriest company as far as customer service. If we ever get another digital or cable company out this way I'll change in a second. Time Warner isn't regulated by anyone and can get away with anything - lying, cheating, horrible customer service.

We have a goofy problem with water line people like that . They messed our lane and field and that was last November , no talks seems to get action......

They will eventually have to pay but I don't know when that will be. We've been hearing that with the economy the way it is that the money may go directly to the mortgage company and not come to us. It's up to the mortgage as to how that's handled. That's what I've heard anyway. If that happens, it will be applied to the principal of our house.
if they've employed 'emminent domain' they have to pay you fair market price for the portion of the property they've taken. and it's not something that gets paid to your mortgage company either. they're taking it from YOU not the mortgage company.
although, since it does affect the mortgage in that the size of the property is now reduced and that would affect the price you could get if you sold, the mortgage company does have some interest in the whole thing - only if you can't sell the property for more than what's left on the morgage and that's your responsibility, not verizon's.
i'd speak with a lawyer about all this - asap.
and you don't want the funds paid to the mortgage company directly...you will receive a 1099 for it so, having it go directly to the mortgage holder doesn't allow you to put any of it aside to cover the tax liability.

when they put in a new Highway here, the price was agreed upon and the papers signed BEFORE any work was even begun. [b] ((friends of my parents had to sell their farm to the state, for a cloverleaf--and they argued with them for a long time, because the price they were offered, and eventually had to take, was far less than it was worth--they had to take it or have the land condemed and "Taken"--so be careful))--[/b]not to mention when the road is done--what is your recourse--ya gonna make them dig it up--???
---have you considered making them buy the whole house???--if you will not be able to ever sell it, it would be a consideration.
and something else to consider... how does your mortgsage read. some read where the lender will NOT take lump sums to go to the principle--or if they do there will be a penalty due--because they WANT the interest that they would of got if you just paid the monthy payments for the full agreed upon loan time. I know Suzie Orman says to pay extra on your mortgage--even if it is 1 payment a year--but my DD says if she and her DH do this, they get penalized--and she is all about saving money--believe me.--if she could do it, she would be.
she said when they borrowed money for her car she had to fight to get that clause taken out, because she knew they were going to be able to pay it off early.
and yes, my SIL has very good credit, and has delt with this one bank, as has his family, for years.

that is all true barb, but since sheri borrowed the money--she is responsible for it.--AND at very least the money should be run thru her and her DH.(a check made out to sheri and her DH but payable to the mortgage company.---how else would she KNOW how much was paid for the strip of land taken for the road??
I can see this all taking place, and Sheri not seeing a penny--and as it is going, it looks like it will happen.--she will have less land, what she has will be less marketable, and she will owe the same money???? not a good situation, for sure.--

We've talked to several people and some of the mortgage companies have required the money come directly to them. This isn't usually the case around here but since all the mortgage crisis stuff that's what is happening. The people to the right of us haven't been paid either but he was told the same as us, that if it is paid to the mortgage lender it will go toward the principal and we will not receive a 1099. He actually has the paperwork that says that so when they come back to have us sign off I guess we will get the paperwork too. He said it is strictly up to whatever mortgage lender we have. That the check will be made out to us but if the mortgage lender wants it we will have to have a court hearing and fight that, which we will not do. If it's going to the principal I'm happy with that. We could have refused to let them work in our yard, which is exactly what our neighbor has done, until we're paid off but it's gonna happen anyway and since we are in the middle of it I didn't want them having to come back and tear everything up again. I think it may add to the value of our house in the end.
Most loans have no penalties for paying off your loan early or making extra payments. I would not take a loan if their was a penalty but that is just me. We pay extra towards our principal every month if we can. We may miss a month here and there but not very often. I think it is terrible that they do that with some loans!!!
Jess I agree totally. If you knew how tight my Daughter was with a dime, you would know if she could of gotten out of taking out a loan like this she would have.---
I think I may have to haver a talk with my SIl and see jsut exactly what the story is..... :wink:
It seems crazy to be penalized for paying off a loan but I guess they're missing their interest. I don't think mortgages fall under that rule. Anyway, it will be the lenders decision if they take this money so they shouldn't be able to penalize us for their own decision. I'll fight them on that one for sure.
I hope to have to never buy another house. I feel sorry for young married trying to start a life. Everything is so over priced. I don't know how people do it. I worked with a woman who was paying her entire paycheck for daycare. She said she was working to be able to have the insurance because her husband didn't have any at his job.
