This plant is growing in front of my house, what is it? The whole plant feels soft, the flowers did'nt start growing until around mid to late August.

I think some kind of datura. Like jimson weed

May be brugmansia?

I looked up photos of Jimson weeds and it looks like that is what it may be, earlier when the first set of flowers bloomed and died I did find one of those round spiny seed pods growing on it like they show on the internet. If it is the Jimson weed the articles I read said that they are poisoness, are they illigal? Should I destroy it?

They're not illegal..
but they are poisonous...

Depends on you and/or do you have kids/
or animals/ or anything you don't want to
eat it?

It can be a mild hallucinogen, in small quatities.

But most of the time, animals in the field
will leave it alone and not eat it, and or
eat around it...

It is also known as "loco weed" for the effect that it has on grazing cattle.

That is a datura, brugmansia flowers hang down.
It's not illegal, DON'T destroy it. Some people have reactions to it, others don't.

does this plant make it's own seeds? If yes where and when do they grow in or on the plant so I can gather them and grow new ones?

They form spiny seed pods after the flowers drop off. They self seed readily, so if some have already dropped off and split open, you probably won't have to worry about starting any yourself as you will have a bunch of volunteer seedlings in the spring.
